The Lake County Cannabis Cultivation Ordinance was adopted by The Lake County Board of Supervisors on March 20, 2018. Ordinance No. 3073 Amending Chapter 21, Article 27 of the Lake County California Code will go into effect on April 19, 2018. The Lake County Community Development Department will begin accepting permit applications for commercial cannabis cultivation on April 19, 2018. Medical and Adult Use cultivation can be permitted. During the initial intake period, permit applicants must be enrolled with the Regional Water Quality Control Board or State Water Resources Control Board for water quality protection programs, unless exempt, no later than April 19, 2018.
Lake County Cannabis Cultivation Ordinance
The new Lake County cannabis cultivation ordinance syncs with California State cultivation license types. Eligibility for all permit types is based upon zoning conformance. Minor Use Permits will apply to cultivation operations with a canopy that is less than 10,000 sq. ft. and/or Nursery operations (License Types 1, 2, and 4). Major Use Permits will apply to cannabis cultivation operations with a canopy that is 10,000 sq. ft. or larger (License Type 3). Type 3 Permits cap at 1-acre of canopy for outdoor, and 22,000 sq. ft. for indoor or mixed-light cannabis cultivation operations.
Upon meeting certain base requirements, applicants may be eligible for Early Activation of a Minor or Major Use Permit. Early Activation would authorize operations this season while a completed use permit application is under review. The durration of a permit is up to ten (10) years. Compliance inspections are required annually, and operators are required to submit a Performance Review Report annually.
